Each trader, providing or acquiring books in a trade on this site agrees to abide by and fulfil all the obligations in these Terms and Conditions. Unless these Terms and Conditions state otherwise, they apply to both to the book supplier, and the book acquirer. Where a term or condition refers to both suppliers and acquirers they are collectively referred to as Traders.

1. Supplier certification

1.1. As a supplier, you are promising to each acquirer and SF-Books that:

a. You have the legal right to be selling the goods you are advertising on this site as being available for trade, and as the owner or agent of the owner of the goods you can deliver effective title to successful acquirers.

b. You have supplied accurate descriptions and/or images of each item that you are trading on this site.

c. You have not relied on any representation made by SF-Books which has not been expressly stated in these Terms and Conditions or upon any descriptions, illustrations or specifications appearing on this website or in any publicity material produced by SF-Books.

d. You are a private individual or a small business.

2. Acquirer certification

2.1. As an acquirer, you are promising to each supplier and SF-Books that:

a. You have completed the SF-Books registration form and have been accepted by SF-Books as a registered trader.

b. You are 18 years of age or older, or I funder 18 years of age, you have your parents or legal guardians permission to trade books on SF-Books.

c. When registering you have provided your real name and address details.

d. You have not relied on any representation made by SF-Books which has not been expressly stated in these Terms and Conditions or upon any descriptions, illustrations or specifications appearing on this website or in any publicity material produced by SF-Books.

3. Trade conduct

3.1. The Participants acknowledge that the trade process is governed by the following provisions.

a. The Participants are solely responsible for all applicable expenses, postage costs, and other costs incurred in the course of trading items on the site.

b. SF-Books is not the selling agent of the provider or the buying agent of the acquirer. At no time is SF-Books providing advice in relation to the items or acting as a consultant.

c. Suppliers must not trade their own goods in order to manipulate their own trader ratings.

3.2. The Participants agree that without limiting the provisions in 3.1 above, in relation to Other Seller Items:

a. SF-Books does not screen, review or control the items being offered for sale to users.

b. SF-Books does not screen, review or control any of the people who participate in the auction.

c. After being notified of the closing of the trade by an automated e-mail from SF-Books, the Participants are solely responsible for finalising the trade of the items and the delivery of the items.

d. SF-Books is not required to get involved in any disputes between bidders and sellers.

4. Trading Procedure

4.1. Supplier Indemnity

a. The suppliers agree to indemnify and will keep SF-Books indemnified for any claim, demand, injury, direct or indirect damage, loss or cost, liability, right of action or claim for compensation in contract, under statute or in tort (including negligence) made against or suffered by SF-Books in connection with or as a result of:

i. the supplier breaching these Terms and Conditions; or

ii. any activity that is expressed in these Terms and Conditions to be the responsibility of the supplier.

4.2. Title to the Goods

The suppliers acknowledge that SF-Books is not the supplier of the supplier's goods and will at no stage ever possess or have title to, or bear risk in relation to, the supplier's goods.

4.3. Responsibility

The supplier is responsible for all customer queries in relation to the goods including but not limited to:

a. Items not being of merchantable quality;

b. Items being of a defective nature;

c. Items not matching description supplied;

d. Items being damaged; and

e. Non-delivery of items.

5. Delivery

5.1 General

a. Each trader must, upon registration, provide a real and accurate address for delivery of all items traded on this site and may include any special requirements in relation to delivery.

b. Bidders certify that when registering as a trader, they have provided a real and accurate address for delivery.

6. Returns policy

a. SF-Books will not accept returns of any items traded on this site, as SF-Books is not the seller of the goods.

b. All complaints should be directed to the seller.

7. Ownership of web site content

a. This site (and each part of it) is protected by copyright law. All rights are reserved.

b. Participants may use the content of this site solely for the purpose of trading books, and for no other purpose.

c. Participants agree to give SF-Books exclusive rights in all the information provided to SF-Books through this site and any information derived or generated from it.

d. In the event a acquirer is successful in its trade for an item, acquirers expressly authorise SF-Books to pass on to the suppliers of the items traded by the acquirer, any necessary details of the acquirer, that the acquirer has provided to SF-Books.

e. The participants will comply with any relevant laws regarding privacy.

8. Title and risk

a. Each supplier certifies to each acquirer that it has beneficial and legal ownership of each item it places for trade on this site, and that effective title to each item will be delivered to the acquirers at the time of delivery.

b. Each acquirer acknowledges that risk in any items traded by the acquirer will pass to the acquirer at the time of delivery.

9. Limitation of liability

a. SF-Books will be under no liability to Participants in respect of any loss or damage (including consequential loss or damage) which may be suffered or incurred or which may arise directly or indirectly in respect of services supplied by SF-Books under these Terms and Conditions or in respect of a failure or omission on the part of SF-Books to comply with its obligations under these Terms and Conditions.

b. SF-Books accepts no responsibility for the content of any trade notice as they appear on this site and acquireres acknowledge that SF-Books has no control over the quality, safety or standard of goods advertised on this site or the truth or accuracy of the information contained in the trade notices and that any illustrations or photographs displayed on this site are solely for the guidance of prospective acquirers and are not to be relied upon.

c. SF-Books will not be liable for any damages (including direct, indirect, consequential, incidental and exemplary) in the event that this site is unavailable to users (by virtue of interruption, suspension or termination) for any reason, including due to computer or communications link downtime attributable to malfunction, upgrades or preventative or remedial maintenance activities.

d. SF-Books gives no guarantee of continued availability of any particular item and will not be responsible should a supplier be out of stock of any item.

e. SF-Books will not be liable for any loss caused by a failure to complete a trade.

f. Acquirers expressly acknowledge that any use of information acquirers gain from trade notices appearing on this site will be at the acquirer’s own risk as SF-Books accepts no liability for the accuracy or reliability of information contained within those notices.

g. SF-Books accepts no liability whatsoever for the misuse of trader’s passwords and log in codes. Traders must protect their passwords and log in codes.

10. Malicious Use

The Participants will not and will not permit another person to cause any Malicious Use of the intellectual property used by SF-Books in relation to the site. Any such use will result in the immediate termination of this Agreement. For the purposes of this paragraph, Malicious Use includes but is not limited to any act, intentional or otherwise, authorised or unauthorised, direct or indirect, which causes unnecessary and unwanted malicious interference with the business operations of SF-Books or which is likely to bring SF-Books or the site into disrepute or ridicule or to lower the commercial value of the site or conducting trades on the site.

11. Acceptance of terms and conditions

a. The Participants agree to be bound by these Terms and Conditions.

b. These Terms and Conditions are subject to change at the sole discretion of SF-Books.
